Statutory Rules for GST Tax Invoices in India (Rule 46 of CGST Rules)

Under Section 31 of the Central Goods and Services Tax (CGST) Act read with Rule 46 of the CGST Rules, 2017, every registered taxable person supplying taxable goods or services must issue a valid Tax Invoice. Failing to adhere to mandatory invoicing guidelines can result in penalty under Section 122 and prevent your buyers from claiming their legitimate Input Tax Credit (ITC).

📋 Mandatory Tax Invoice Fields

  • Supplier Information: Legal/trade name, address, and 15-digit GSTIN.
  • Sequential Invoice Number: Up to 16 characters containing letters, numbers, and hyphens/slashes unique for each financial year.
  • Date of Issue: Must be issued on or before removal/delivery of goods or within 30 days of rendering services.
  • Recipient Details: Name, address, and GSTIN (for registered B2B buyers) or place of delivery for B2C supplies over ₹50,000.
  • HSN / SAC Code: Mandatory 4, 6, or 8 digits based on annual turnover thresholds.

⚖️ Tax Breakdown & Place of Supply

  • Intra-State Supply: When supplier state equals place of supply, tax is divided equally into CGST (Central Tax) and SGST (State Tax) or UTGST for Union Territories.
  • Inter-State Supply: When supplier state differs from buyer state/place of supply, full IGST (Integrated Tax) applies.
  • Reverse Charge Mechanism (RCM): Mandatory declaration indicating whether tax is payable on reverse charge under Section 9(3) or 9(4).
  • Signature: Physical signature or authorized electronic digital signature of the supplier.
